Ms. Sarrah McNeil stated that this was done as RFP 2022-11. It was  
advertised on Public Purchase and accessed by 18 vendors. One  
response was received. An evaluation committee made of three people  
evaluated the proposal and it was scored based on the RFP requirements.  
After all the evaluations were computed, the committee is recommending  
an award to Maher Duessel. The cost of the total contract is $204,400.  
We have successfully done business with this vendor before.  
Ms. Cynthia Mota thanked Ms. McNeil and asked if there were any  
questions from the dais.  
Mr. Ed Zucal stated that Council approved something for an audit a while  
back. He asked Mr. O'Neil about it and he stated that it was to keep him  
out of it. Is this different than what we talked about before when we  
approved that money. He stated that there was an audit that the city gave  
money for and he asked Mr. O'Neil why can't we do the audit in-house.  
Mr. Michael Hanlon stated that this is the audit that Council is responsible  
for doing.  
Mr. Ed Zucal stated that is what he is asking. What is the difference  
between that one and this one.  
Mr. Seth O'Neill stated that this was one is required by the Charter and as  
Mr. Hanlon said, it is a function of Council even though the administration  
provides the information. He stated that he thinks Mr. Zucal is referencing  
is the internal cost analysis for the General Fund Services and the Fee  
Study that there was a sense that if the Finance Department or the  
Departments was to try to figure out their own cost allocation there is a cost  
that may not have been considered completely neutral. The General Fund  
Service Charges is something that they are currently and the city has a  
contractor for that. He thinks that is probably what you are referencing.  
Mr. Ed Zucal stated that he believes that Mr. O'Neill is right about that. He  
just wanted to make sure that the city was not doing a double audit.  
Mr. Seth O'Neill stated no. This one is very specific and annual.

Ms. Sarrah McNeil stated that this was done as an informal quote. The  
quote provided by Faces International LLC is below the purchasing  
threshold and only one quote is required. The cost of the contract is $3,900  
and we have successfully done business with this vendor before.

Mr. Ed Zucal stated yes.  
Mayor Matt Tuerk stated that he wants to add and it will answer any  
questions. He apologized for the need to ask Council to Suspend the  
Rules to consider this one. It is a timing issue. If we had gone through the  
normal channels we would have not had enough time to appropriately mark  
the Juneteenth Event. He apologized for the need to ask Council to  
Suspend the Rules. In the case of this, there is internal debate and this is  
the same firm that we used in 2021 for marketing the Juneteenth Event.  
There was some internal debate of whether this contract needed to come  
before Council, but ultimately we decided to play it safe and say let's have  
Council vote on it as a Professional Services Contract.  
Mr. Ed Zucal stated that here is the issue that he has, Council approved as  
Ms. McNeil said before prior contracts with this company to do certain  
work. We are now giving them $3,900 to do extra work which was not ever  
included in the original contract with them. He would think that is a violation  
of some sort. He is not the Controller, but would think that if this had been  
included in the original contract that we give money for example: any future  
contracts that the city would need performed. This would include that,  
except for the amount of money. That has not been done here.  
Mr. Seth O'Neil stated that he does not believe this is an instance where  
they are doing incrementalism where they are trying to do it in stages to get  
below the threshold. This is two completely separate events.  
Mr. Ed Zucal stated that is his concern that it is two separate events.  
Mr. Seth O'Neil stated that they are two separate events in two separate  
years. An annual celebration.  
Ms. Sarrah McNeil stated correct. These are two separate complete  
different contracts.  
Ms. Cynthia Mota stated that she really likes to hear from the Solicitor. She  
asked Mr. Smith if he had anything to say about that.  
Mr. Charles Smith stated that he would first like to hear what the Controller  
has to say. He understands that they are qualifying it and saying that it is a  
separate event and it would not have been anticipated under the prior  
agreement.  
Mr. Jeffrey Glazier stated that he does not necessarily review the contracts,  
he does review the payments and take a look at what we are paying them  
for. Typically, this has been hired for specific events. Last year, they may  
have done work on one or two different events and probably contracted  
separately for each of those. New year, new event, new contract. In his  
opinion this is fine. It is not incrementalism. He thinks the administration,  
except for the timing issue is doing what they need to do properly.  
Ms. Cynthia Mota asked if there was any other question from the dais.  
Ms. Ce Ce Gerlach asked if they get any of that federal, state money or  
whatever it is from Juneteenth. Did we apply for that and did we get any?  
Is there federal money coming down.  
Mayor Matt Tuerk stated not that he knows of. In the 2022 budget that  
Council approved we had an item for Juneteenth. That is not supported by  
federal grants in any way.  
Ms. Ce Ce Gerlach stated that she was reading something somewhere.  
She knows Bethlehem does their event and there is a committee. Are we  
on that committee?  
Mayor Matt Tuerk stated that we normally detail this in greater detail in the  
future Council during the Mayor's Report. This is as part of the Juneteenth  
Celebration, we are doing a flag raising on June 12th. There is an event  
happening at ArtsQuest on June 18th and we will hold a larger event in the  
city of Allentown on June 19th at Cedar Beach. That is done with the  
Juneteenth Foundation. It is a regional organization that is celebrating  
Juneteenth. They may have applied for federal funding. He is not sure if  
they were successful.  
Ms. Ce Ce Gerlach asked if Faces will be just doing the marking for  
Allentown, not everyone.  
Mayor Matt Tuerk stated correct. The marketing includes the preparation  
of a flyer for the event itself. Another flyer for the sports events that are  
taking place. They will be doing banner advertisements for our social  
media use and then they will be producing a 30 second video to promote  
the event itself. Those materials will be provided to the City of Allentown  
and we will be responsible for the distribution and messaging.  
Ms. Ce Ce Gerlach stated cool. They did an awesome job last time. They  
will do another awesome job.  
Ms. Cynthia Mota stated that is what she was about to say. The city has  
worked with them before and they really do a great job. They are from the  
city of Allentown. They have their business here and the reality is they have  
done a lot of work for the city of Allentown. When they do the job, they  
always perform very well.  
Mayor Matt Tuerk stated that they pointed out in the past when the  
contracted out with the MBEs and DBEs and WMBEs and Face  
International and MBEs based in the city of Allentown. For us, particularly  
working with an Allentown business is a huge win.

Mr. Michael Hanlon stated that Council has two notifications. One  
notification is from Council President Mota that pursuant to the Ethics Code  
this is a notification that she met with Mr. Alan Jennings who was  
requesting ARPA Funds regarding housing. He received a notification  
from Ms. Gerlach and she stated that she is disclosing that on 5/2/2022 at  
1:00 PM, she met with Alan Jennings to discuss housing needs in  
Allentown. This led to a conversation about ARPA Funds. Also present,  
was Council President Mota. We met in Michael Hanlon's office.

REPORTS  
Mayor's Report (3 minutes)  
Mayor Matt Tuerk stated that he wanted to mention the events that have taken place  
in the city of Allentown. He wants to focus on some of the highlights that the city  
did. He stated that Mr. Hendricks attended the Ribbon Cutting at the Public Safety  
Building. He stated that the city is very excited for the public to be welcomed in an  
environment. He was very happy to see Chief Roca testify for a House of  
Representatives Committee meeting on dirt bikes providing good information for  
across the state that will seek legislative solutions that will better for our streets to  
be safe. Additionally, he wants to mention the Chief Roca received an award at the  
Leonard Buck Banquet. There is still an opportunity for any City Council member  
or any member of the public to attend the Citizens Police Academy. It begins on May  
24. He strongly encouraged them and stated that it is an excellent opportunity to  
know what the Allentown Police Department does. He recognized the Allentown Fire  
Department for the Sound the Alarm event that they conducted on Saturday.  
Working with the American Red Cross and the City of Allentown with a great group  
of volunteers installing 112 smoke detectors in homes between 4th Street and 8th  
Street and north of Tilghman. Those were in 62 different homes. Hopefully, it will  
lead to saving lives. He spotlighted the ground breaking that we held on April 22nd  
for the Da Vinci Science Center which is a significant investment. Governor Tom  
Wolf and a huge number of dignitaries. This will have a tremendous impact on the  
kids here in Allentown. He recognized the department of Public Works for the Earth  
Day celebration on April 23rd in the Art Park. An awesome opportunity for the  
department of Recycling and Solid Waste to communicate with our Allentown  
residents about the importance of recycling. He recognized a handful of community  
groups that cleaned up in places like Dieruff High School, Hanover Avenue, and  
recognized Chris Brown in Old Allentown for the hundreds of trees he has planted in  
the past few years in the city of Allentown. In addition to the Department of Public  
Works, he wants Council to know that they have conducted preliminary interviews  
with candidates for the permanent position of Director of Public Works. We hope in  
short order have a candidate for City Council for confirmation. It is a tough decision  
with the candidates, but will have them in front of City Council in short order. He  
recognized the Parks Department Tyler Fatzinger and Rick Holtzman for the Arbor  
Day Celebration at the Wire Mill on April 29th. It was a fantastic event. He wanted  
to go back to Public Works for a second. He congratulated the Public Works  
Department, the Police Department and the Fire Department for doing a very good  
job of getting the streets shutdown for the St. Luke's half marathon on Sunday, April  
24th. He thanked the Polish American Citizens Society for helping the city raise the  
flag in recognition of Constitution Day in Poland of May 3rd. He reminded Council,  
that the city will be raising the flag of the Delaware Nation to celebrate the Lenape  
people in the Lehigh Valley. They will begin the Summer Concert Series with over 30  
concerts scheduled. The first one will be in West Park on May 14th at 7:00 PM.  
Ms. Candida Affa asked about the applications for Public Works, will Council be able  
to look over the applications.  
Mayor Matt Tuerk stated that they conducted the interviews. He does not know  
what the prior practice has been. The administration will select a candidate and be  
presented to City Council.  
Ms. Candida Affa stated didn't we have access to their resumes.  
Mayor Matt Tuerk stated that when they bring forth the candidate, they will detail it in  
a memo the summary version of their resume with the salary when the  
administration ask them to confirm the candidate.  
Ms. Candida Affa asked if it will be the resumes of that candidate or all the  
candidates.  
Mayor Matt Tuerk stated just the candidate that we will be bringing forward.  
Ms. Cynthia Mota asked if there were any other questions from the dais. She

Controller's Report (3 minutes)  
Mr. Jeffrey Glazier stated that there are a bunch of Audit Reports listed on the  
Agenda. He commented on the most recent one that they released which is the  
review of the Stop/Loss compensation for the city's Stop/Loss Insurance. He stated  
that the city is self insured for medical insurance. The city pays dollar one for  
medical and prescriptions. What institutions do that are self insured is determine  
what amount of loss they can withstand and the go out and buy insurance for  
anything above that and the city's case we have about a $250,000 limit and then we  
go after reinsurance on the amount above that. It allows us to budget with some  
confidence and about what our expenses would be and we know if we have an  
employee or an employees family member who is sick, really sick, we know that they  
will be taken care of and those bills will be paid. At some point, the Controller's  
office decided to take a look at these contracts and the compensation that our  
insurance consultant which is BSI was earning for them. BSI was hired under a  
contract at the end of 2017. They are a part of that proposal. They gave us a  
technical proposal and a cost proposal and the cost proposal listed how they were  
to be compensated. The major item is that they would be paid a commission of nine  
percent on the Stop/Loss Insurance. This is not an uncommon arrangement in the  
industry. Some groups will just go with a flat fee. Some would go hourly. BSI's was  
nine percent. Not unusual. We had a Stop/Loss Insurer called Sun Life for a number  
of years, they endured some of the years of the worse experience the city had and it  
was felt that to re-up with them would have been exceptionally expensive. BSI went  
out and did some data analytics and felt that we were going to have some good  
years ahead us and they went out and did a great job for the city looking to get us  
the best deal. Their compensation is in their contract. When the Stop/Loss  
insurance went through the channels, it was for the premium only. At some point it  
was realized and that contract was amended. What caught the Controller's office  
interest was instead of amending it for a nine percent commission, it was amended  
for a $17 per enrollee flat fee. They went back and looked at all the bills for 2021 and  
weighed them and found it was a $42,000 difference not in our favor. They looked at  
the 2022 contract that now has $19 per enrollee and found out year to date (January  
through March) about $12,000. The city met with BSI and it is fair to say that they  
have a disagreement with them. The contract we have, is the contract we have and  
it needs to be honored.  
Ms. Cynthia Mota asked if there were any questions from the dais or the public.  
Mayor Matt Tuerk stated that the Solicitor's office is performing and audit based on  
the evidence that was presented to us by BSI in our meeting. He disagrees quite a  
bit what the City Controller just offered there. There is some fault on behalf of the  
previous administrations that we have to work to resolve. He had a conversation  
with the Solicitor a little earlier related to the original contract itself. There are some  
problems with the original contract. He would not agree that the city amended or  
the previous administrations amended that contract. The way that Stop/Loss  
insurance is purchased by our consultant resulted in a separate agreement that sets  
apart from our contract. That may have been presented to Council and Council  
approved those Contracts.  
Mr. Jeffrey Glazier stated that the BSI Contract went to Council. The individual  
Contracts Insurance does not go to Council because the thinking being since they  
are not city solicitations, they don't need to come to Council.  
Mayor Matt Tuerk stated that they constituted an amendment of the original  
Consultant's contract.  
Mr. Jeffrey Glazier stated that Mayor Tuerk is correct. BSI contract has never been  
amended. It was the Stop/Loss Contract that needed to be amended, but the  
amendment went way too far and impinged on the authority of the BSI Contract.  
Mayor Matt Tuerk stated needless to say the administration working in collaboration  
with the Solicitor's office is performing a review. We did send a letter to BSI based  
on the analysis that was performed by our Finance Department and upon further  
information provided by BSI. we are looking at a review. One thing that should be  
pointed out and expand on Controller Glazier offered is that BSI and the work that  
they have done has saved this city a significant amount of money.in that 2022  
Stop/Loss Contract.  
Public Hearing: City Council will hold a Public Hearing on the re-zoning of property  
at S. 6th ST. and W. CUMBERLAND ST on May 18th at 6:15 PM.

will basically consist of some road widening at the intersection along with  
some new sidewalks, some new crosswalks and new traffic signals at that  
location.

Amending the 2022 Capital Fund Budget to provide for a transfer of Thirty  
Thousand Two Hundred Ninety-Two Dollars and Eighty-Nine Cents  
($30,292.89) as a transfer of funds from Capital Project 1228 – Paper  
Recycling Transfer Facility to the Recycling and Solid Waste Fund, closing  
the Paper Recycling Transfer Facility Capital Project and re-purposing the  
funds by placing them in accounts to cover costs for crack sealing, seal  
coating, line painting and paving at the Drop Off Center and Yard Waste  
Site; to provide additional costs ($8,000 price increase) for the conveyor  
on the cardboard baler being purchased this year and to provide for the  
purchase of rolling carts for the drop off center to alleviate lifting and  
making it safer for the employees.

Mayor Matt Tuerk asked for Bill 31 to be withdrawn from the Agenda.  
Through consultation with the cabinet, they felt it was more appropriate to  
get an ARPA Project like this be submitted after they get the application  
process for all of the projects. The administration will be referring this  
project after they had an opportunity to appropriately promote the available  
finances.  
Ms. Cynthia Mota stated that she thinks it would be a great idea. Everyone  
should have a chance to come forward. She asked if there were any  
questions from the dais or the public.

GOOD AND WELFARE  
Mr. Ed Zucal stated that Johnny turned 17 and wanted to drive his dad's car  
so his dad said well, you need to bring your grades up a little bit, read the  
Bible, and get your hair cut. About a month goes by, Johnny said dad my  
grades came up. Yeah, they did. He stated that he has been reading the  
Bible. His dad said yes, you did, but you still haven't gotten your hair cut.  
His son said well, in the Bible Moses had long hair, Sampson had long hair  
and even Jesus had long hair. His father said yeah, they walked  
everywhere too.  
Mayor Matt Tuerk stated that Mr. Zucal did bring up grades. He stated that  
he wanted to encourage everyone that recently he attended the Partnership  
Summit held by the Allentown School District in collaboration with the  
Allentown Chamber of Commerce which Dr. Stanford released an Entry  
Plan Report that includes a four point plan for improving outcomes at the  
Allentown School District. These are available from the school district in  
print or on the school district's website. He encouraged Council to read  
and understand this Report and think about how you can support the  
Allentown School District. It is the linchpin for the this entire region. If this  
Allentown School District is not doing well, not only does the city of  
Allentown not do well, but the entire region suffers. Finding ways to support  
the needs of the School District and changing the culture of the district,  
ensuring positive outcomes for our students, improving governance at the  
district to improving the financial performance at the district. Find out  
where you can help them.
