Authorization for Contract with Tyler Technologies in the amount of  
$791,980 to provide an upgrade to the City's Enterprise Resource  
Planning system.  
Ms. Sarrah McNeil stated that Tyler Technologies is our current ERP  
vendor. The city will be updated Eden to Munis. n Eden will no longer be  
supportive as of 2027. The city would need to start the transitioning  
process. This will basically be an upgrade to the current ERP system  
which is the most cost effective approach and ensure the easiest transition  
to this city.

Ms. Sarrah McNeil stated that this was done as an informal quote. They  
received four quotes. Three quotes were no quotes. This was coming  
before Council as it's a professional service.

Authorization for a Change Order for Construction Master Services, LLC in  
the amount of $49,110, previously bid, the project was to reconstruct the  
sidewalk, ADA Ramp, diamond plate drains, Flagpole foundations, and  
curb as needed along Penn St. (adjacent to City Hall).  
Ms. Sarrah McNeil stated that this is with Construction Master Services,  
LLC which was a previously awarded contract that is requesting additional  
funds in the amount of $49,110. The reason for this is for an unexpected  
layer of grout under the sidewalk and the plans the city had for when the  
plaza was originally done was incorrect. Do to the cost of the Change  
Order being over 10 percent over the contract, the amount is being  
presented here to Council.  
Mr. Daryl Hendricks thanked Ms. McNeil and asked if there were any  
questions from his colleagues.  
Mr. Ed Zucal stated that this is 25 percent of the whole project. In the last  
sentence, it says therefore the sidewalk would have to be excavated with  
jackhammers to save the integrity of the garage.  
Mr. Mark Shahda stated that the intent was to use heavier pieces of  
equipment to removal it. When they discovered when there was grout  
below the surface, they have to use jackhammers to remove six inches of  
concrete so they wouldn't have to disturb the grouting below the surfaces.  
Mr. Ed Zucal asked if they are talking a one inch difference.  
Mr. Shahda stated that the difference is over 5800 square feet. The  
additional labor and materials that were needed were five inches vs. six  
inches.  
Mr. Daryl Hendricks stated that in other words it becomes manual rather  
than recognized that caused the difference.  
Mr. Shahda stated correct. It cost more than expected to complete the job  
with extra materials for 800 square feet.  
Mr. Daryl Hendricks thanked Mr. Shahda and asked if there was anybody

Ms. Sarrah McNeil stated that Buckman's Inc is a previously awarded  
contract that is requesting additional funds in the amount of $17,200. Due  
to the budget being due prior to receiving bids for these pool chemicals,  
they did not anticipate the cost to come in at what it did. Also, due to the  
weather conditions, the pools were in a higher demand using more pool  
chemicals. Due to the cost of the Change Order over 10 percent of the  
contract amount, it is being presented before Council.

reference to personnel matters and investigations. He stated that was held

has submitted the Minimum Municipal Obligations which are part of this  
agenda. Executive Session Announcement: verbiage forthcoming  
Received an email from Mr. Jerald Hartney in IT that he recently had  
conversations with the following companies to request quotes for products  
or services that we need to be purchased or renewed.  
MMO Communication: Pursuant to Act 205, the Director of Finance has

Public Hearing: Council President Hendricks A Public Hearing has been scheduled  
on Wednesday, October 4, 2023, at 6:15 PM in Council Chambers. City Council will  
consider for possible adoption an Ordinance amending the Zoning Map and Zoning  
Ordinance of the City of Allentown by rezoning certain parcels at 51 N. Front St. and  
115 Riverside Dr to B-5 Urban Commercial District, and by adding adds a text  
Amendment that provides additional requirements for B-5 properties, provides for a  
repealer clause, a severability clause, and an effective date.  
Budget and Finance: Chair Napoli, Hendricks, Gerlach The Committee has not met  
since the last council meeting; the next meeting is scheduled on October 4th at 5:15  
PM in Council Chambers.  
Community and Economic Development: Chair Mota, Napoli, Affa The committee met  
on the 13th and forwarded one item that is scheduled for a Public Hearing on  
October 4; the next meeting is scheduled on October 4th at 5:40 PM in Council

Mayor’s Report (3 minutes)  
Ms. Genesis Ortega, Communications Manager, stated that she is here on behalf of  
Mayor Tuerk to deliver the Mayor's Report. As you know the Mayor's office launched  
the Refugee Welcome Days last Tuesday in partnership with the Refugee Center at  
the Episcopal Church of the Mediator. The purpose of the Welcome Days is to  
welcome and facilitate information and assist in supporting families who are  
resettling and residing in Allentown. At the first session last Tuesday, they had over  
50 refugees who spoke five different languages in attendance. The Mayor's office  
facilitated interpreters for each of those different dialects. They appreciate the  
various participation of various departments, including the Allentown Police  
Department, Recycling, Constituent Services and Health. As well as the community  
partners including LANTA and the Allentown Public Library. This partnership  
between the city of Allentown, Bethany and the Refugee Community Center will  
support Welcome Days quarterly through 2024. Under the leadership of Lucinda  
Wright in the Mayor's office, they are also launching five DEI trainings sessions in  
this third quarter to over 140 managers in the city of Allentown. The sessions run  
from September 27th through December 7th on somewhat of a bi-weekly basis.  
Lucinda is also working to execute the Language Access Plan that was presented in  
August. They are in the process of rolling out a Communication Enhancement  
Initiative called the ISpeak cards. These cards are designed to address language  
needs and can help facilitate effective communication and ensure that individuals  
who speak different languages or have specific language preferences can  
understand and be understood. ISpeak cards will be posted at all city counters and  
offices open to the public. It is very simple to use. Individuals just need to point to  
specific language and our employees would use the language line to provide  
support. Laura Ballek - Cole in the Mayor's office is wrapping up the Second Annual  
Employee Engagement Survey. She stated that as you know it is a confidential  
questionnaire that ask employees to share feedback with the administration about  
their experience as a city of Allentown employee so they can continue the work in  
making it a better workplace overall. At this point, they are nearing 350 responses.  
That is about a 42 percent response rate and look forward to reviewing and sharing  
that feedback with Council later this year. Their goal is to surpass last year's. They  
are looking at a 66 percent response rate. The next City Hall at the Table is  
scheduled for next Tuesday, September 26 at Ritter Elementary School at 5:30 PM.  
During this session, they will be piloting a youth parallel event for children ages four  
to 12. These sessions are opportunities for residents to join city officials to voice  
their opinions and share their ideas for making things better so together they can  
develop solutions that lead to progress. They look forward to continuing these  
conversations with residents and invite Council to join them that night. Two final  
notes: They are excited to share that the City of Allentown is now certified as better  
city for pets thanks to the work done by Michaela Boyer in the office. This  
certification recognizes to welcome pets, offer pet friendly programs and amenities  
and help keep people and pets together through tough times. They joined just over  
100 cities in the United States to receive these certifications. It means that they have  
met benchmarks in several areas to support pet friendly shelters, homes, parks and  
businesses. They are also excited to share that they received $920,000 for an  
application from the USDA for a Service and Community Forest Service Urban and  
Community Forestry. There is more to come on this, but the highlight is that the  
project will support urban forest management with a focus on trees in the public's  
right away thanks to the Parks Director, Many Tolino. The Mayor's office is working  
very hard towards a welcoming and a more inclusive city internally and externally.  
They are very proud of the work they were able to accomplish 20 months in and  
appreciates the assistance in supporting the change they are looking to make in the  
community. They welcome Council's participation in achieving those efforts and  
appreciate your support.

Amending the 2023 Capital Fund Budget to provide for a transfer of One  
Hundred Fifteen Thousand Dollars ($115,000.00) from the Trexler Fund to  
the WPA Structures capital fund to complete the repair work to the Lehigh  
Parkway Phase 4. This is part of the 2023-24 Trexler Capital Project  
allocation.

Ms. Ce Ce Gerlach stated that she thinks she might need a point of  
explanation and clarification. With the Human Resources Department,  
there is Garry Ritter, former Health Department Director. He is holding  
down the department and then we have the consultant who is doing what.  
Ms. Bina Patel stated that he is assisting Garry with the other tasks. She  
stated that Garry is managing the staff and seeing day to day activities  
where the consultant is helping with the matters of the other personnel.  
Ms. Ce Ce Gerlach asked if Ms. Patel can elaborate with that is. She  
asked how much is the consultant paid.  
Ms. Bina Patel stated conflicts with the personnel is what the consultant is  
assisting with. The Transfer for the Human Resources is $30,000. She  
stated that she does not have the exact amount that is being paid, but can  
get that information for her.  
Ms. Ce Ce Gerlach asked if Ms. Patel knows a round about. Is it $20,000  
or $500,000 or $2.00.  
Ms. Bina Patel stated that she does not have the hourly rate for her. It is not  
$2.00 and it is not $100,000.  
Mr. Daryl Hendricks stated isn't it $30,000.  
Mr. Ed Zucal stated no, that is the increase.  
Ms. Bina Patel stated $30,000 is a Transfer they are requesting to cover  
through the end of the year.  
Mr. Daryl Hendricks stated that is for the consultant that we are speaking  
of.  
Ms. Ce Ce Gerlach stated that is in addition to what he is already getting.  
She asked is he living here in Allentown. She asked if the city pays for his  
lounging when he is here. She stated for her she is a little hesitant  
because they don't what they already paid him. They have Garry that is  
more than competent to hold down a department. Why do we have a  
consultant and an Interim HR Director or Acting HR Director.  
Ms. Bina Patel stated that he does not live in Allentown. He comes in a few  
days to help and the other days he is on call. She stated just his services.  
It is not lounging.  
Ms. Bina Patel stated that if she could share just one task that he is working  
on. The city's PPM needs to be updated and currently this consultant is  
reviewing all the documents that should be included in PPM. He is revising  
that along with the personnel matters. She asked if Council can table items  
#1 and #2 until they can get a clearer picture of how much they pay them  
and exactly what they are doing.  
Ms. Bina Patel explained item number 1.  
Mr. Ed Zucal stated that Council would have to make a motion to do that.  
Ms. Ce Ce Gerlach stated that she does not want to do that until Ms. Patel  
has spoken.  
Ms. Bina Patel stated that Item #1 also includes the Parking Authority  
payment. The city rents spaces from the Allentown Parking Authority, 200  
spaces. The cost for them is what this includes, the $109,300 includes the  
cost for the spaces the city rents from the Parking Authority.  
Ms. Ce Ce Gerlach stated that it would really be Item #2.  
Mr. Daryl Hendricks stated that it is referring to him.  
Mr. Ed Zucal stated that they should make a Motion to table Items 1 and 2.  
He stated that they don't know how many parking spots or what they are  
talking about here or how much the city is paying them already.  
Ms. Ce Ce Gerlach asked is that a Motion.  
Mr. Ed Zucal stated no, that is his comment.  
Ms. Ce Ce Gerlach asked if anyone had any questions or comments so  
she doesn't make this Motion and it shuts conversations.  
Ms. Cynthia Mota stated that no one knows how much they are paying at  
this point.  
Ms. Ce Ce Gerlach stated that she is sure they do, but she doesn't know  
and Ms. Mota doesn't know.  
Mr. Daryl Hendricks stated that it is not broken down definitively.  
Mr. Ed Zucal stated that he is only here three days a week, roughly.  
Mr. Bina Patel stated with the Parking Authority she can provide the  
information to her. It is 100 spaces that they rent for the Parking Authority.  
Depending on the employees joining the city or departing from the city as  
an employee that number changes, but average it is 100 parking spaces  
that they rent per month. She stated that they need to pay for the parking  
spaces and encouraged Council to approve Item #1.  
Ms. Ce Ce Gerlach stated that she hears that and it is 100 spaces.  
Ms. Bina Patel stated that otherwise they will be late on payment for those  
invoices. They are using the parking spaces. They are renting the spaces.  
They have to pay the invoice.  
Attorney Charles Smith stated that it hasn't been a second yet. He asked  
what is the Motion now.  
Mr. Ed Zucal stated that he would second it.  
Attorney Charles Smith stated let's articulate to keep it clear, what is your  
Motion now. He asked if they are confining it to Subsection II.  
Ms. Ce Ce Gerlach stated that she would be ok with that. She made a  
Motion to Table and does not know if there are any comments allowed.  
She would be interested in others opinion on it.  
Mr. Michael Hanlon stated that it will be a Motion to Amend the Resolution  
by taking out that transfer.  
Ms. Ce Ce Gerlach stated yes, the Transfer #2.  
Mr. Ed Zucal stated that he would request, including Number 1. He asked  
how much are we paying them now? And, how many parking spaces?  
Ms. Bina Patel stated that the monthly amount is $100 per parking space.  
On the average, currently the city has 200 parking spaces and depending  
on the employees joining them or departing as an employee that number  
varies. On the average, it is 200.

Ms. Bina Patel stated that this will cover the city through the end of the year.  
Mr. Ed Zucal stated that is a lot of money. He suggested the Council  
cleans up the Motion.  
Attorney Charles Smith stated that his understanding that it is now framed  
as a Motion to amend the Resolution. It is not a Motion to table, it is a  
Motion to amend. Council is seeking to remove certain subsections. You  
are moving to amend R160 before it is voted on.  
Ms. Ce Ce Gerlach stated yes.  
Ms. Cynthia Mota stated let's say that Council amends one. What will  
happen? Will they charge us more or it is going to be a penalty? What  
happens if we amend this for later on?  
Ms. Bina Patel stated on Item #1, if the city does not pay the invoice on  
time, it will be a penalty assessed.  
Ms. Cynthia Mota asked how much are we talking about.  
Ms. Bina Patel stated that it is a percentage base, but she does not have  
the amount for them today. She stated that the city has been penalized in  
the past for not paying the invoice on time. She stated that is why she is  
encouraging them to approve Item #1. She can get the detail for them for  
Item #2. She just does not have it with her currently.  
Ms. Ce Ce Gerlach stated that she is willing and if someone else wants to  
make a separate Motion to Table Item #1, they can. She is willing to  
amend her Motion to only include Item #2.  
Attorney Charles Smith stated what he believes is happening. That is Ms.  
Gerlach is making a Motion to amend R160 to remove Sub Item #2,  
$30,000 in Human Resources for funds transferred to cover contract for HR  
consultant. An expense that was not budgeted for 2023. He stated that is  
the extent of her Motion.  
Ms. Ce Ce Gerlach stated that is it.  
Attorney Charles Smith stated that has been seconded. He stated that  
Council can have debate on that Motion, if they would like.

don't have any real information on it. She stated that Council just was told  
that he is going to do this and going to do that. Council just needs a little bit  
more information on that.  
Ms. Bina Patel stated that she has a brief description and if she can  
describe to them what services that he does provide. He provides Human  
Resources consulting to assist the Human Resources department, roughly  
three days a week due to shortages in staffing and lack of knowledge. He  
does bring in expertise in HR even though they do have Garry Ritter who is  
managing the staff. He does not have the expertise that this consultant  
brings that we need for the city.  
Ms. Ce Ce Gerlach stated that she appreciates that and just seeing a  
numerical breakdown and metrics achieved, especially when hiring a  
consultant. What has been achieved thus far? What will be achieved from  
now to 2024. She stated a breakdown on what they are spending the  
money on. She stated that would be helpful.  
Ms. Bina Patel stated that they will get that for them.  
Ms. Candida Affa asked if this consultant is going to paid until they find an  
HR Director.  
Ms. Bina Patel stated that is correct.  
Attorney Charles Smiths stated that they have to vote on that Motion.  
Mr. Daryl Hendricks stated to allow for public comment. He asked if there  
was any comments from the public.  
Mr. Patrick Palmer, 617 Allen Street, asked if the consultant works three  
days a week. How many hours per day does he work.  
Ms. Bina Patel stated that he is here all day and longer than eight hours on  
many days.  
Mr. Palmer asked if it is roughly $10,000 a month.  
Mr. Daryl Hendricks stated that in all fairness these are the questions that  
they need to find out. He stated that Council does not know those answers  
and Ms. Patel does not have them readily available.  
Mr. Palmer stated that it is almost $1,000 per day that you are paying  
someone which equates to $365,000 a year. He stated that Ms. Patel  
stated that it was three days a week that he works at $10,000 a month.  
Mr. Daryl Hendricks stated that they don't know what the perimeters are.  
He can't say if it is per year.  
Ms. Vicky Kistler stated that she is not familiar with the contractual  
obligations of Mr. Trant or in the HR department or the dollars and cents.  
She stated that Garry Ritter is a 38 - year long employee of the city, but he  
is not a Human Resources employee. He is willing to step up and to help  
manage the staff. To approve time off, to look at paperwork, to approve  
Purchase Orders and Requisitions, and to do that type of management.  
He is not certified in HR and not an HR professional. Mr. Trant is and what  
he has done for the city she can attest to. She can't speak to the dollar  
amount, but he has cleared through the grievance hearings that have been  
backlogged for over a year. He has met with the union to look at any issues  
of arbitration and issues that are complicated Human Resource issues are  
handled by Mr. Trant. He is in the process of rewriting the entire Personnel  
Policies and Procedures Manual that hasn't been updated since 2009. He  
is addressing some of the issues that was brought up during the Report  
that was given to Council about inaccuracies in FMLA. Those are some of  
the activities that she can attest to that he has worked on since he was  
here. She stated that she can tell them that it has been a tremendous help  
for those in the management tier to have an HR professional work through  
some of that background. Although, he may be physically present here  
one, two or three days a week stating that she is not exactly sure. He is on  
Teams and has been on Teams in meetings with them and has been  
available to her personally as well as some others 24/7, if they have an HR  
related issue. He is able to be contacted. She stated that she is sure they  
can get them better information on the rate of pay and hours of pay. The  
work he is doing is the work that needs to be done in her mind by a  
certified HR professional.  
Mr. Daryl Hendricks thanked Ms. Kistler for her input. He asked if there  
was anybody else.  
Ms. Candida Affa thanked Ms. Kistler and stated that she clarified a lot of  
things. She stated she knows they need help in HR. Until Ms. Kistler  
specifically told them the job of Trant and Ritter it is a lot more clear to her.  
The only thing they need is figures.  
Mr. Eddie Aviles, 386 W Gordon Street, stated that he knows that he can't  
address questions to her. He stated that he is a little confused. She was  
talking about 200 parking spots. She mentioned that number, but then she  
said 100 that the city actually have 100 employees.  
Mr. Daryl Hendricks stated that they are not talking about parking spots  
right now. They are strictly talking about Item #2.  
Mr. Aviles stated that you were talking about.  
Mr. Daryl Hendricks stated not anymore. He stated that they are not on that  
subject any longer.  
Mr. Aviles stated that he wanted to speak on that. before someone goes.  
Attorney Charles Smith stated that Mr. Aviles can speak on the amendment  
that is being proposed which is removing $30,000 in Human Resources for  
funds transferred to cover the contract for the HR consultant and that is the  
Motion to Amend that is in front of them. The point is that they are debating  
whether a Motion should pass and the Motion is confined to the removal of  
that section that talks about the $30,000 in Human Resources to cover an  
HR consultant. He stated that is what he would have to speak to at this  
time.  
Mr. Aviles stated that he understands that, but Ms. Patel can't give us an  
answer to anything for the last two weeks. Any question you ask Ms. Patel,  
she can't provide an answer to. He stated that he is baffled and confused  
and asked Mr. Hendricks does he understand where he is coming from.  
Mr. Daryl Hendricks stated that after the meeting you can speak to her, and  
she will be more than happy to speak to you.  
Mr. Aviles stated that this is a public meeting. The public needs to know  
what is going on, not just him.  
Mr. Daryl Hendricks stated that they need to know what's going on  
regarding the Amendment that was made.  
Mr. Aviles stated that they should not give the mayor any more money.  
Figure out what is going on before we give the mayor any more money. He  
asked why he can't talk about the parking. That is a lot of money. It is  
$109,000.  
Mr. Daryl Hendricks stated that they can find out that information for him,  
but not right now.  
Mr. Aviles asked when.  
Mr. Daryl Hendricks stated after the meeting. He stated that he would be  
glad to get his name.  
Ms. Cynthia Mota asked Mr. Hendricks if they can allow Ms. Gerlach to  
speak for a second.  
Ms. Ce Ce Gerlach stated that there will be an opportunity if someone  
wants to speak on something other than #2 which is that $30,000. If you  
want to speak on the parking, the traffic planning, Public Safety and police  
painting vehicles, on Fleet Maintenance, Council is going to vote on that  
separately. She stated that he will come up when Mr. Hendricks ask any  
questions from the public.  
Ms. Cynthia Mota stated that you have a chance to speak.  
Mr. Daryl Hendricks asked if there any other comments related to the  
Motion.  
Mr. Daniel Quinones, 2349 W Allen Street, asked about the $30,000 being  
added to what he is already being paid. Is he going to perform any more  
hours for this.  
Mr. Daryl Hendricks stated that those are the details that Council wants to  
find out. They don't know that. They will find that out.  
Mr. Daryl Hendricks stated that they are back to R160 minus #2. He asked  
if there were any comments from his colleagues or the public.  
Attorney Charles Smith stated that the Motion as amended is something  
that you can make public comment on.  
Mr. Eddie Aviles, 386 W Gordon Street, stated Ms. Patel mentioned the  
number 200 and the city is paying for 200 parking spots, but then she  
mentioned that there were about 100 employees using them.  
Ms. Bina Patel stated $100 a month on the average they have about 200  
employees. He stated that this is the same Parking Authority that Mr.  
Hendricks is on the board of. He stated that they give these guys all these  
contracts to buy these properties. Why are we paying anything to the  
Parking Authority.  
Mr. Daryl Hendricks stated that they are a business. They are independent  
of this city.  
Mr. Aviles stated that Mr. Zucal is trying to walk with integrity right now. He  
stated that $109,000 to the Parking Authority who is already making  
millions off the citizens of Allentown. It is too much and that needs to be  
regulated. He stated that you are on the board and maybe instead of  
paying $100 a month for the city, maybe get that down to $50 per month.  
Cut the cost there. He stated that Mr. Hendricks has an obligation to the  
citizens of Allentown.  
Mr. Daryl Hendricks stated that you are entitled to your opinion. He stated  
that he will work on that.  
Mr. Aviles stated that you are supposed to work for us. Now work for us on  
both aspects.  
Ms. Ce Ce Gerlach asked when does the contract that would govern that  
amount end. When will they be able to make some changes.  
Ms. Bina Patel stated that the Parking Authority's contract is an ongoing  
contract, and she does not have the terms. All of the details she can get for  
them. The parking spaces are partially funded by the employees. It is not  
just the city of Allentown employees paying for the parking spaces.  
Ms. Ce Ce Gerlach stated that is even worse. It would be helpful to see the  
contract and know what's in it. She asked Ms. Patel to expand upon stating  
that it is a ongoing contract. What does that mean? Does it mean that if  
you or us want to revisit the terms of the contract.  
Ms. Bina Patel stated that they have a contract for an x number of years  
and there is an option to renew when she says it is an ongoing contract.  
What year of the contract are we currently in. She stated that is information  
that she does not have on her currently, but can get that for them.  
Ms. Cynthia Mota stated that they should just vote on this and move on.  
She does not have all the information. Let's move forward.

Attorney Adam Rosenthal, Deputy City Solicitor, stated that he has a  
prepared statement from the Solicitor's office. The Home Rule Charter  
gives City Council the authority to conduct investigations. The Home Rule  
Charter states that the matter of an investigation must be specifically stated  
in the authorizing ordinance. Section 201 of the Home Rule Charter states  
Section A, in addition to the Authority of the City Controller to conduct  
audits under 403D of this Home Rule Charter, Council shall have the power  
by ordinance to make or cause to be made investigations, audits or  
studies of the city and the conduct of a city department office or agency and  
for this purpose may retain professional and technical assistance,  
subpoena witnesses, administer oaths, take testimony, require the  
production of evidence and provide funds for such investigation audit and  
study. Section B states the subjects of such investigation, audit or study  
shall be specifically stated in the authorizing ordinance. Based on legal  
analysis prepared by the Solicitor's office and provided to the Mayor and  
City Council, the following are the recommendations of the City Solicitor:  
City Council directly or through duly authorized investigation should not 1:  
have access to confidential city employees personnel files 2: interview city  
employees or former city employees publicly or privately regarding  
employee complaints 3: have access to privileged communications  
between the City Solicitor's office and any city employee, city official or any  
member of a city authority, board or commission that the City Solicitor  
office represents and 4: make any recommendations regarding specific  
employee action. He stated that those are the recommendations of the  
City Solicitor.  
Mr. Daryl Hendricks thanked Mr. Rosenthal.  
Mr. Ed Zucal stated that in reference to his request for an ordinance. That  
will be introduced at the Committee of the Whole meeting. There will be a  
Press Release tomorrow indicating where they are with this investigation  
and some of the things that have occurred. Stay tuned.  
Mr. Daryl Hendricks thanked Mr. Zucal and asked if there were any  
comments from the public.  
Mr. Pas Simpson, 215 N. 9th Street, stated that he is a little confused  
because he could have sworn that the Solicitor said that the third-party  
investigator shouldn't be allowed to interview. He understands not going  
through files, but speaking to past employees, speaking to current  
employees that are currently going through this situation. How do you  
investigate if you don't speak to the people that are going through it. It is  
very important that we do this thoroughly because we have seen the  
aggression. It is not just behind closed doors. He stated that they get  
Rules of Engagement in dealing with City Council and the Council  
President doesn't have to follow them. He can go back and forth, but they  
can't go back and forth with him. We have to protect all of our citizens. He  
may not always agree with Eddie, but today he was not out of line. He  
stated that we have to learn how to listen. Even if they were upset last  
week, this week is a new week. He always tells his kids that today is the  
first day of the rest of your life. We have to act like it is and allow these  
people to speak, be willing to listen, and willing to act. He thanked Mr.  
Zucal for being bold in your actions right now. Please do not allow them to  
push us where we can't speak to everyone involved to get the best possible  
service for our people. Don't leave no stone unturned because we need to  
understand why is it ok for our Council President to be so aggressive with  
people that look like him. He does it every two weeks. He stated that he is  
a victim of it.  
Mr. Daryl Hendricks thanked Mr. Simpson.  
Mr. Simpson stated that he still has time to talk. That is again, an act of  
aggression.  
Mr. Daryl Hendricks stated to stick to the subject at hand.  
Mr. Simpson stated that you do not get to do that. These are acts of  
aggression and you do it every two weeks.  
Ms. Karen Ocasio stated that she is one of the HR Generalist here. She is  
one of the people like she said two weeks ago filed an EEOC Complaint  
and with the PHRC. She emphasized that there are a lot of people going  
through stuff here and they have to have this investigation happen. This is  
just a way to sweep it under the rug again and trying to not to get the  
investigators not to speak to her to get the truth out. This is all that is all to  
be hidden from what is really happening within. She stated that they really  
need to uncover the rug to start cleaning up. It is going to just keep building  
up under the rug and it is only going to get worse. Until something really,  
really big happens and they don't have any other choice, but to address it.  
She stated please, please get this investigator so they can uncover  
everything that is happening in the city. She stated that if they need  
permission from the people, she is sure there are a lot of people here who  
will be willing to speak to them. She is one of them. What investigator and  
where does she sign up? Please, please get this investigator for the city of  
Allentown.  
Pastor Daniel Blount, Ripple Church, stated two weeks ago when  
everybody counted, it was not done properly. Was it? Because everybody  
spoke at the same time. He stated that Mr. Hanlon did not ask if Council  
individually voted. Everybody just voted at the same time. Could that  
railroad what was said to be done? Normally, Mr. Hanlon says how do you  
vote.  
Ms. Ce Ce Gerlach stated that it was a common consensus instead.  
Pastor Blount stated that everyone said yes and he never seen that before  
when you want to put something forward in terms of the investigator.  
Attorney Charles Smith stated that he believes the Clerk recorded it as a 7  
- 0 vote.  
Pastor Blount stated don't you have to do it in order or does it matter or  
don't it matter.  
Mr. Ed Zucal stated that was only for the Resolution to free up the money.  
That has nothing to do with the actual investigation. Well, it does, but not  
the actual investigation itself. It was just a common consent that they agree  
to release the money to start the process for the investigation.  
Ms. Ce Ce Gerlach stated that it is the first step.  
Pastor Daniel Blount stated that the second thing is all the people that have  
been dismissed, how many have been hired back.  
Mr. Ed Zucal stated that is something that the investigation would have to  
discuss.  
Pastor Daniel Blount stated it is about four to five, if not more. He stated  
that his thing is Mr. Hendricks stated that the city did not have money.  
Mr. Daryl Hendricks stated that he did not say that. He stated that he did  
not think it was a smart way to spend city money. Many of the  
investigations may have been already investigated.  
Pastor Blount stated that he misunderstood and if that was the case, it  
would have to go to the people that you would hire. He does not think it is a  
misplace where to put the money.  
Mr. Daniel Quinones, 2349 W. Allen Street, stated that his concern is in  
regards to this Bill. If they are limiting the field of this investigation by not  
questioning all the people and members involved and if so, it will be cutting  
off the investigation. There is no investigation to be had then. It defeats the  
whole purpose of it.  
Mr. Ed Zucal stated that if he could say one thing. Let the ordinance be  
introduced and it will spell out exactly what Council is going to do. He  
stated let the Ordinance be introduced and he is sure that Mr. Quinones'  
questions will be answered.  
Mr. Patrick Palmer asked if the ordinance going to be introduced right now.  
Mr. Ed Zucal stated that it is going to the Committee of the Whole. It will be  
a meeting.  
Mr. Patrick Palmer asked what date is that.  
Mr. Michael Hanlon stated that it is being introduced right now.  
Attorney Charles Smith stated that it is being introduced for the First  
Reading right now. Council is taking public comment prior to a referral. It  
is under Public Comment prior to a referral to a committee. He stated that  
he believes it will be referred to the Committee of the Whole. He  
suggested that if they Google Allentown Legistar, it will bring up the  
document on tonight's Agenda and you can see the contents of the  
ordinance. That goes for every week. There is a lot of public information  
up there.  
Mr. Patrick Palmer stated that he had a question, but is not sure it is going  
to be answered. He mentioned not questioning. How would you do an  
investigation at that point.  
Ms. Barbara Redmond, Secretary with the NAACP - Allentown Branch,  
stated she wants to make it known that if there is nothing to hide, there  
should be a thorough investigation. Every person that is involved in the  
investigation should be interviewed. She feels as though they need to  
move forward and need to do this thoroughly and asking that the NAACP  
be involved because they are the ones that actually started this complaint.  
They would like to be involved and who will be investigating the employees,  
who is going to investigating the city of Allentown. They would really like to  
know what is going on. They don't want to throw this under the table.  
People are being hurt, abused, misused. They are being bullied every day  
at work and this has to stop. They need a thorough investigation and they  
would like to be involved. She stated that she appreciates their  
consideration.  
Mr. Ed Zucal stated that a member of the NAACP cannot be involved as far  
as the investigation because it is Council's investigation. However, during  
the RFP process, you will find out and it will be discussed under contracts  
who gets that award.  
Ana Negron has been with the city since 2007, starting out with the Streets  
Department and mentioned before that there were things going on that  
should not have gone on. Ana went to the Solicitor, Human Resources  
(HR) and went to everyone and everything including the union. The union  
was friends with the people that were reported stuff to in which everything  
got leaked. There was retaliation, bullying, harassing and everything to do  
at work was not good enough to the supervisors or management. Was  
ridiculed and made fun of and was given crap jobs and learned to enjoy  
now because it did make changes to the city. Ending up cleaning a lot of  
the alleys and the streets with the litter and trash and wanted to do is to  
come to work and attend to the city and clean up the city, talk to the people,  
inform the people. Even though not having the title of a Sweep Officer that  
now has, but did inform the people before and help out the people before.  
There are a lot of cries, there are a lot of cries. Hearing a lot of cries from  
the people now of what they are going through. Now having a lot of  
problems at the job because there are a lot of questions and empty  
answers. Just want to do the job and not feel that nauseous in the morning  
or think about where will it be written up for today. Everything that is done is  
above and beyond because the city needs it. Many of Council may not  
have seen what was seen on these streets. Many of these people's lives all  
destroyed and all we do as city employees is basically take the last  
pennies out of their pockets. That is not fair. Getting to build a lot of  
relationships with the community and from day one has done that here in  
the city of Allentown and will keep on. Being told that talking too much and  
take too much time to help out, but if certain jobs were not done to educate  
the people. If people are not educated on how to maintain the properties or  
even if they have to. Some, don't care to know, some just don't know, and  
some need further education. We all need to stick together. The  
employees and the Allentonians. If anything, there will not be any of you  
guys as well. If we let the people rot, there will not be any of us. We all  
have to stand together and if there is a problem or question about the job, it  
should be answered truthfully. Feeling that anything brought to the table, it  
is a no. You are doing too much. Wanting to get Allentonians safe with  
safer and cleaner streets. There are a lot of people open to drug dealings,  
drug houses, drug spots, prostitution homes, sex slaves going around in  
certain neighborhoods, drugs as well. And, been reporting drug spots  
since 2007 and does not care whoever calls it a snitch. By caring about  
the surroundings and the ground walking on. Caring about the safety and  
requested it here in the city and was assaulted here in the city. Had a hit  
and run twice, assaulted, cussed at, threatened all the time and the job is to  
go and survey homes. If there is a fence with a gap in between having to  
get a picture of someone's yard and not feeling safe. There are pit bulls  
that are bigger in these alleys. There are drug dealings and drug people  
bent over and are high on drugs. Requested pepper spray, and it is  
something that will not be provided. A police officers' life is more  
important. A police officer stays in the car, has a gun, has a badge, has a  
taser, and everything to protect himself. Mr. Daryl Hendricks stated that  
your time has expired.  
Ana Negron said getting harassed and threatened because of snooping  
around their property, wanting pepper spray for protection after being  
assaulted by people in the public and asked for equipment to perform the  
job safely and be in peace.  
Mr. Tino Babayan, Eastside of Allentown, stated that he is sitting here  
listening to everybody. Listened to the attorney and asked if they turn it  
down today, it is not going to happen. He asked with the ordinance, can  
Council help them figure it out. He asked if the attorney is saying that you  
can't do the investigation or are you still going to do the investigation.  
Attorney Charles Smith stated that the attorney stated the position of the  
administration on providing the information. What is happening right now is  
a first read of an ordinance and under consideration is public comment  
prior to referring that ordinance to a Committee of the Whole. They still are  
on Bill 87 which is on the agenda and has not been acted on and the  
reason that you have been given an opportunity is because prior to a  
referral, Council entertains public comment.  
Mr. Tino Babayan stated that it will be in your best interest to do this  
investigation. He stated that there are a lot of people looking at this  
meeting and he does not want to say who it is. For Council's best interest  
and the mayor's interest you need to do this investigation to clear his name  
and your names.  
Ms. Natasha Phillips, 103 S. 8th Street, stated she has a concern when it  
says public safety. She is trying to figure out why the city of Allentown has  
police in a park where they don't control the kids. Where kids are being  
bullied, threatened with guns, and it is being told to staff and the Allentown  
Police Department and it has been about three weeks now. No one has  
done nothing or reached out to her or has concerns or the care of the safety  
of her child. It is an ongoing issue because it is a few kids that it is going  
on with this situation, but she is frustrated because if these police are not  
telling kids to break up fights in the park.  
Mr. Daryl Hendricks stated that it is totally off subject.  
Ms. Natasha Phillips stated that it is public and safety.  
Mr. Daryl Hendricks stated that they are talking about an ordinance  
introduction. He asked Ms. Phillips to give Mr. Hanlon her name and he will  
give to Ms. Affa who is chair of the Public Safety Committee. She can  
contact you and get that information.  
Ms. Natasha Phillips stated that she has been hearing that for the last three  
weeks. She stated that her son got shot at today behind this incident.  
Mr. Daryl Hendricks stated that he will assure her that Ms. Affa will be  
getting back to you.  
Attorney Charles Smith stated if he may, Council is entertaining something  
on the agenda.  
Ms. Ce Ce Gerlach asked if someone could get her name and number.  
Her kid just got shot at. She understands there are procedures.  
Mr. Daryl Hendricks stated no speaking from your seat, please. The  
subject at hand is the ordinance that is being referred and that is what the  
subject should be spoken to.  
Ms. Karen Ocasio stated that this is a mother and you do have a child,  
right. You have children. She stated that we should be able to come up  
here and voice our concerns and at least at the moment, please let her  
vent. She is going through something where her child just got shot at. She  
stated to Mr. Hendricks that he keeps dismissing what the people have to  
say. As they said earlier, you guys are here because of the public.  
Ms. Candida Affa stated that Ms. Phillips walked out and would love to get  
her name. She stated that she chairs Public Safety. That is her number 1  
priority. They will discuss it and have a name. When you have Courtesy of  
the Floor, this is when you discuss this. What the president is trying to say,  
this has nothing to do with that. You are not allowed to have those  
comments. She asked if you can get me her number and her name she  
swears and promise that she will call her and try to rectify. She stated that  
she will call the Chief. Right now, it is something else we are discussing.  
Ms. Ce Ce Gerlach stated just a point of clarification on the statement from  
the administration in terms of who can or can't do investigations. Just to  
clarify, that is City Council. She stated that they cannot interview, they  
cannot do any of that stuff. That is what the statement says. In the Charter,  
it clearly states that they can require production of evidence. She stated  
that she looks forward to the investigation and fully supports it. She stated  
a full thorough investigation.

Councilperson needs to make a motion: I make a motion to submit the  
attached letter of intent to the Governor's Center for Local Government  
Services to request technical assistance and to have the Clerk attest to the  
same.

Mr. Michael Hanlon stated that at the CD Committee, there was a  
discussion about a Motion needed. This is a Motion that the CD  
department needs to get technical assistance from the state. He asked  
someone to make that Motion.  
Mr. Daryl Hendricks asked if they don't need to take comments on this Mr.  
Hanlon.  
Mr. Michael Hanlon stated that he does not think so.  
A motion was made by Cynthia Mota, seconded by Ed Zucal, that the CD  
department needs to get technical assistance from the state.

GOOD AND WELFARE  
Ms. Ce Ce Gerlach stated that the last meeting she called in and had a  
feeling that as long as we have this investigation that is out there, some of  
these meetings will continue to be tense. At the time someone comes up  
and maybe they are talking at a spot where they should not be. We are  
people and have emotions. She stated to Mr. Hendricks that he has been  
attacked a lot and she know how that is. Yes, they are elected, but they are  
human beings. It is important for them to really make sure that whatever  
Rules and Procedures they have in place in terms of back and forth with the  
public they stay hard and serious with those. If the Rule is that we are not  
going back and forth with the public, they need not do that. She stated that  
they were following that so well. She stated that so many times she wanted  
to and said oh I can't. So that there could not be allegations of oh, you have  
three minutes, and you cut that person off, but you did not cut that person  
off. Perhaps they can figure out a way to be a little more standard. She  
stated that they are going to continue to have people in. It seems like this  
is what is going to happen. She stated that she goes back to 2020.  
Remember, how tense that was.  
Mr. Daryl Hendricks stated and for now on three minutes, you are done and  
five minutes you are done for a group. They will become more strict. It  
calls for that. He stated that he appreciates their comments to that extent.  
This is a place of government and expect a certain decorum and that will  
be followed. Going forward, someone may get removed. He does not  
want to remove anyone and wants to listen to everybody, but people have  
gotten out of hand. It should not be. They have to follow a certain decorum  
and everyone needs to follow it likewise.  
Ms. Ce Ce Gerlach stated that if she could just with one more comment.  
Most people are not City Council junkies like them. They don't show up for  
Council meetings all the time. They don't get the procedure and  
recognizing it. Not throwing away decorum, but having some grace.  
Ms. Cynthia Mota stated that it is a teachable moment.
